Terms and Conditions

Dilan Collective, operating under dilangold.com, established in Rotterdam, registered with the Chamber of Commerce (KVK) under number 78520274.

1. Definitions

• Dilan Collective: the seller, established in Rotterdam

• Customer: the person or entity entering into an agreement with Dilan Collective

• Consumer: a customer who is a natural person acting for purposes outside their trade, business, or profession

• Parties: Dilan Collective and the customer together

2. Applicability

These terms and conditions apply to all offers, orders, agreements, and deliveries of products and services by or on behalf of Dilan Collective.

Deviations from these terms are only valid if explicitly agreed upon in writing.

Any general terms and conditions of the customer or third parties are expressly excluded.

3. Prices

All prices are stated in euros (€), include VAT, and exclude additional costs such as shipping, unless otherwise stated.

Dilan Collective reserves the right to change prices at any time.

If price increases occur after the agreement is concluded due to unforeseen circumstances, the consumer has the right to terminate the agreement, unless the increase results from legal obligations.

4. Product Representation

Images, photos, colors, and descriptions on the website are indicative and may vary slightly from the actual product.

No rights can be derived from these representations.

5. Payment

Payment must be made within the agreed term.

If the customer fails to pay on time:

• Interest of 1% per month may be charged

• Collection costs may apply in accordance with Dutch law

Dilan Collective reserves the right to suspend its obligations until payment is received.

6. Right of Withdrawal (Consumers Only)

Consumers have the right to withdraw from their purchase within 14 days without giving any reason.

The withdrawal period expires 14 days after receiving the product.

Conditions:

• The product must be unused

• Must not be custom-made or personalized

• Must be suitable for return (hygiene-sensitive items excluded if opened)

The product must be returned within 14 days after notification.

Return shipping costs are the responsibility of the customer.

Refunds will be issued within 14 days after receipt of the returned product or proof of shipment.

7. Delivery

Delivery takes place while supplies last.

Orders are delivered to the address provided by the customer.

If payment is not completed, Dilan Collective may suspend delivery.

8. Delivery Time

Delivery times are indicative.

Exceeding delivery time does not entitle the customer to compensation or cancellation unless delivery is delayed by more than 14 days after written notice.

9. Shipping & Risk

The risk of loss or damage transfers to the customer once the product has been delivered.

10. Transport and Shipping Costs

Shipping costs are borne by the customer unless otherwise stated.

11. Complaints

The customer must inspect products upon receipt.

Complaints must be reported:

• As soon as possible

• No later than 2 months after discovery (for consumers)

12. Returns & Exchanges

Returns and exchanges are subject to the Return Policy.

Exchanges are only possible if:

• Requested within 14 days

• Product is unused and in original condition

Customized items cannot be exchanged.

13. Liability

Dilan Collective is only liable for direct damages caused by intent or gross negligence.

Dilan Collective is not liable for:

• Indirect damages

• Loss of profit

• Consequential damages

Liability is limited to:

• The amount covered by insurance, or

• The invoice amount

14. Force Majeure

Dilan Collective is not liable for failure to fulfill obligations due to circumstances beyond its control, including but not limited to:

• Natural disasters

• Supplier failures

• Transport issues

• Internet or technical failures

• Government measures

Obligations are suspended during force majeure.

If force majeure lasts longer than 30 days, both parties may terminate the agreement.

15. Retention of Title

All products remain the property of Dilan Collective until full payment has been received.

16. Intellectual Property

All content on the website (images, texts, designs) remains the property of Dilan Collective and may not be used without permission.

17. Privacy

Personal data is processed in accordance with our Privacy Policy.

18. Amendments

Dilan Collective reserves the right to amend these terms.

Consumers may terminate the agreement if changes significantly affect them.

19. Applicable Law

All agreements are governed by Dutch law.

Disputes will be submitted to the competent court in the Netherlands, unless mandatory law states otherwise.

20. Final Provisions

If any provision is found invalid, the remaining provisions remain in force.
